Digital Millennium Copyright Act (“DMCA”) Policy

Neckles IO (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond expeditiously to claims of copyright infringement committed using the Neckles IO website (neckles.io) if such claims are reported to our Designated Copyright Agent.

1. NOTIFICATION OF COPYRIGHT INFRINGEMENT

If you are a copyright owner (or authorized to act on behalf of one), please report alleged copyright infringements by completing a DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent. Upon receipt of the Notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged material from the Site.

Your DMCA Notice must include the following:

• Identification of the copyrighted work that you claim has been infringed.
• Identification of the material that you claim is infringing (including the specific URL or location on the Site so we can find it).
• Your contact information, including your full legal name, mailing address, telephone number, and email address.
• A statement of “Good Faith”: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement of “Accuracy”: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Your physical or electronic signature.

3. COUNTER-NOTIFICATION

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our Copyright Agent. Your counter-notice must include your contact information, identification of the removed material, and a statement under penalty of perjury that you have a good faith belief the material was removed in error.

4. REPEAT INFRINGER POLICY

Neckles IO takes copyright seriously. In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
